TERMS AND CONDITIONS

  1. Information on how to enter and the prizes form part of these Terms and Conditions.
  2. Participation in this promotion is deemed acceptance of these Terms and Conditions.
  3. The Promotion is run by Blooms The Chemist Management Services Ltd (ABN 64 003 584 718) of Suite 1, Level 1, 15 Bourke Rd, Mascot, NSW 2020 (“Promoter”).
  4. Entry is only open to Australian residents who are aged 18 years or over and either a registered Pharmacist, pharmacy student, intern Pharmacist or qualified Pharmacist (“Entrants”).
  5. Entries into the promotion open at 12.00pm AEST on 23/03/2023 and close at 4:59pm AEST on 26/03/2022 (“Promotional Period”).
  6. This Blooms The Chemist APP 2023 Pharmacist Focus Survey Promotion (“Campaign”) is a game of skill and chance plays no part in determining the winner.
  7. To be eligible to enter, individuals must participate in the Pharmacist Focus Video Booth, or Pharmacist Focus Online Survey during the Promotional Period (“Qualifying Action”).
  8. To enter, individuals must ensure they fill out all required fields on the entry forms, including Full Name, email, phone number, postcode, age bracket, career stage, job description, job status, geographical location of employment and employer details, and submit the fully completed entry form during the Promotional Period (“Entry”).
  9. Judges will take into account the accuracy, the quality, originality and insight of the Entry as well as the relevance of the Entry to the Campaign, and any other factor that the judges consider relevant in determining the winner(s) of the Prize.
  10. Multiple entries are permitted, subject to the following:
    1. only one (1) entry permitted per Qualifying Action, and
    2. each entry must be submitted separately and in accordance with entry requirements.
  11. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole and absolute discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter’s sole and absolute discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
  12. Entries not completed in accordance with these Terms and Conditions will be rejected and any late, incomplete, indecipherable, or illegible Entries will be deemed invalid.
  13. Where the Entry caps the maximum amount of time allowed, only the first words up to that cap will be considered as part of the Entry and all subsequent words will be disregarded.
  14. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole and absolute discretion, to determine the identity of the entrant.
  15. Any costs associated with applying, entering or participating in the Campaign (including internet access and download charges) will be at the cost of the Entrant.
  16. Entrants agree to their Entry being used by the Promoter in the future and grant the Promoter a non-exclusive, royalty-free, perpetual, worldwide, irrevocable and sub-licensable transferable license to use, reproduce, modify, adapt, publish and display the Entry for any purpose in any media without compensation, restriction on use, attribution or liability. Entrants warrant that they have full authority to grant these rights and will not assert any moral rights in respect of the Entry.
  17. Entrants warrant and agree that:
    1. They will not submit, produce, upload or share any content that is fraudulent, or may be in breach of any intellectual property, privacy or other rights;
    2. No rights in the Entry have been previously granted to any person, corporation or entity;
    3. They will obtain full prior consent from any person who has jointly created or has any rights in the Entry or who appears (or who’s property appears) in the content forming part of the Entry;
    4. They will comply with all applicable laws and regulations including without limitation those governing copyright, content, defamation, privacy, publicity and the access of use of others’ computer or communication systems.
  18. Without limiting the above, the Entrant indemnifies the Promoter against all loss, damages and costs incurred by the Promoter as a result of any breach of the above warranties.
  19. Entrants understand, acknowledge and agree that:
    1. Their Entry (or parts thereof) may be posted on the Promoter’s and Participating Stores’ website and social media channels and available for public viewing; and
    2. By participating in this Campaign, information, links or names may be displayed on the website or social media channels of the Promoter’s and/or Participating Stores.
  20. Unless expressly permitted by these Terms and Conditions, participation in this Campaign does not entitle any person or Entrant to use any of the Promoter’s intellectual property rights (including any trademark or content) for any purpose.
  21. At the end of the Promotional Period, the Promoter will judge all valid Entries received during the Promotional Period taking into account the Judging Criteria.
  22. There will be one (1) winner of a $2000 travel voucher selected from the Pharmacist Focus Photo Booth entries received throughout the Promotional Period. There will be one (1) winner of a $500 travel voucher selected from the Pharmacist Focus Online Survey entries received throughout the Promotional Period. The entries will be reviewed at Blooms The Chemist Head Office – Level 1, 15 Bourke Rd, Mascot NSW 2020 within the first ten (10) business days after entries close. For the avoidance of doubt, no judging will be conducted during the weekend or on a public holiday in the State of New South Wales (NSW). The Promoter may select additional reserve entries and record them in case an invalid entry or ineligible entrant is selected. The winners will be notified in writing within fifteen (15) business days of the winners being selected and their names will be published online at www.joinbloomsthechemist.com.au landing page.
  23. The Promoter’s decision is final and no correspondence will be entered into.
  24. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified in writing. No change will be provided for unspent portions. Any ancillary costs associated with redeeming the travel vouchers are not included. We recommend all travellers obtain travel insurance against cancellation or amendment fees, theft, loss or damage of personal luggage and effects as well as providing sufficient medical cover. Redemption of the Voucher is subject to any terms and conditions of the issuer including those specified on the Voucher. Voucher terms and conditions include, but are not limited to,12 months validity from date of issue (The Prize will be subject to the applicable package conditions at time of booking. Bookings are subject to availability). Spending money, meals, insurance, passports, visas, vaccinations, transport to and from departure point, transfers, items of a personal nature, in-room charges and all other ancillary costs are not included. The Prize cannot be transferred to other persons or parties.
  25. The Promoter will not be liable for any Voucher that is lost, stolen, damaged or tampered with after it is awarded.
  26. The Promoter will use its reasonable endeavours to deliver the Prize to the Winner within 28 calendar days of being selected pursuant to the above clauses.
  27. If the Promoter is unable to contact a Winner, or the Winner does not claim their Prize within three (3) months of being notified they are a Winner, then that Winner will forfeit their Prize and no cash or other prize will be awarded in lieu.
  28. It is an Entrant’s responsibility to notify the Promoter if their personal details change during the Promotional Period. If a Winner fails to provide a valid or complete email address for delivery of the Prize, or delivery has not been successful to an address provided (after reasonable attempts by the Promoter) the Prize shall be forfeited by the Winner.
  29. Prizes are not transferable or exchangeable and cannot be taken as cash. If any Prize is unavailable, the Promoters may at its sole and absolute discretion substitute the Prize with a prize of equal value.
  30. All Entries become the property of the Promoter.
  31. As a condition of accepting a Prize, a Winner may be requested to sign legal documentation in the form required by the Promoters, including a release and indemnity form.
  32. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome).
  33. If this Campaign is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole and absolute discretion, to the fullest extent permitted by law:
    1. to disqualify any Entrant; or
    2. subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
  34. The Promoter may in its absolute discretion, but subject to State and Territory laws, modify, suspend, cancel, recommence or extend this Campaign as appropriate if:
    1. for any reason, this Campaign is not capable of running as planned due to technical, hardware or software failures or interferences, or changes to third party sites or platforms, which affect the administration, operation, security, fairness, integrity or proper conduct of the Campaign;
    2. the level of interest or participation in the Campaign is insufficient or there has been some delay in commencing the Campaign; or
    3. the Entry determination of Winners or delivery of Prizes is prevented, hindered or affected by any external agent or event beyond the reasonable control of the Promoter.
  35. If any term or condition of these Terms and Conditions or the application thereof to any person or any circumstance shall be or become illegal, invalid or unenforceable, the same shall be read down, if such reading down is possible, and if found to be impossible, shall be severed and the remaining terms, agreements and conditions shall not be affected.
  36. If the Prize is to be provided to the Promoter by a third party, the Prize is subject to the terms and conditions of the third party prize supplier and the provision of the Prize is the sole responsibility of the third party not the Promoter. The terms and conditions which apply to the Prize at the time it is issued to the Winner will prevail over these Terms and Conditions, to the extent of any inconsistency. The Promoter accepts no responsibility or liability for any delay or failure by the third party to deliver the Prize, any delay or failure relating to the Prize itself or failure by the third party to meet any of its obligations in these Terms and Conditions or otherwise.
  37. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
  38. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of:
    1. any technical difficulties or equipment malfunction (whether or not under the Promoter’s control);
    2. any theft, unauthorised access or third party interference;
    3. any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter;
    4. any variation in prize value to that stated in these Terms and Conditions;
    5. any tax liability incurred by a winner or entrant; or
    6. use of a prize.
  39. The Promoter collects personal information (“PI”) in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at https://www.bloomsthechemist.com.au/privacy-policy. In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. The Privacy Policy also contains information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter.
